The LEASE NOTIFICATION form includes lease commencement and termination details. It is NOT a Lease Agreement; it is a Lease Notification to the Society.
When a Lease Notification is recorded with the Society, a Lessee is eligible to show the horse under their membership providing they are a Financial Member of the Society. In regards to breeding from a horse, it enables the Lessee of a mare to register progeny born whilst the lease is effective. In the case of a stallion, the Lessee is authorized to complete and sign breeding records for matings during the period of the lease.
The Society recommends that the Owner/Lessor and Lessee seek legal advice and obtain a written agreement in relation to the Lease, listing all mutually agreed clauses deemed necessary. The Society accepts no responsibility in relation to Lease arrangements and has limited powers to intervene.
LEASE NOTIFICATION
- The Lease Notification must be completed and signed by the Owner/Lessor and Lessee of the horse and submitted to the Society.
- Payment of fees (and Reissue fee, if applicable) is an agreement between the Lessor and Lessee. If the ORIGINAL Certificate of Registration is NOT submitted with the Lease Notification, a reissue fee will apply. If payment of fees is not received, it will be assumed that the Lessee will pay fees.
- The Lessee must be a Financial Member of the Society. Leases will not be effected to unfinancial or Non-Members of the Society.
- The Lease Notification records a commencing and terminating date. If the terminating date is not provided, the lease will automatically terminate within twelve months of commencement.
